The Judicial Board for Economic Disputes of the Supreme Court of the Russian Federation confirmed the position of TSK Mosenergo LLC in a legal dispute with the Committee on Prices and Tariffs of the Moscow Region in the case of compensation for losses caused to a resource-supplying organization by the establishment of economically unjustified tariffs. This is stated in the company's message.
In particular, on June 10, 2026, the Supreme Court issued a ruling in case no. A41-57028/2024 and overturned the decisions of the Courts of Appeal and Cassation, upholding the decision of the Arbitration Court of the Moscow Region.
The Committee insisted that the refusal of the subsidy was legitimate, since the Company had ceased to meet the formal criterion of ownership of the property on the date of selection. This position was supported by the courts of appeal and cassation. The courts proceeded from the fact that the state registration of the transfer of ownership in itself deprives the Company of the status of a resource-supplying organization and the right to receive subsidies.
The Supreme Court of the Russian Federation, having studied the arguments of the cassation appeal of LLC TSK Mosenergo, recognized them as worthy of attention and referred the case to the Judicial Board for Economic Disputes.
The higher court pointed out the error of the lower courts, which replaced the substance of the dispute with a formal feature. The Court stressed: "The formal non-compliance of the Company with the criteria on the date of selection does not exclude the Committee's obligation to compensate for losses."
The court confirmed that by setting preferential tariffs for the population, public law education is obliged to compensate resource-supplying organizations for losses incurred in providing public utilities/resources to the population.
